Winning Your Case: 5 Top Tips for How to Win Your Personal Injury Claim

June 2, 2020 by kevinwilkerson Leave a Comment

In the United States, auto accidents are a common occurrence, and yet you never expect it to be you who is injured in one. Unfortunately, thousands of people are reminded each day that they are not exempt from auto accidents.

If you’re injured in an accident, then you’re probably wondering what you can do to get right financially. In most cases, you will have to take the other driver and their insurance to court to get full compensation. Read on to learn how to win your personal injury claim.

1. Get Representation ASAP

If someone else caused your injuries, then you’re going to need an attorney to help you navigate the claims process. This should be done well before you’re ready to file a claim.

Why? Attorneys are experienced in working with insurance companies. The sooner you have them on your side, the sooner you can begin building your case and taking the right steps for success.

2. Document, Document, Document

Any time you file a claim for damages or take an insurance company to court, you are going to be asking for compensatory damages. That means you’ll be asking the court or the company to provide you with enough money to cover property damage, medical bills, pain and suffering, and the like.

In order to prove that you’ve actually suffered these damages, you’re going to need documentation to back up your claim. Keep all your receipts and bills on hand to show your total expenses.

3. Be Careful About Sharing

It’s human nature for us to want to share everything that’s going on in our lives with our friends or on social media. When you’re in the process of seeking compensation for an injury, however, you will want to minimize the amount of information you share about your injuries.

In fact, you may want to limit the personal information you share totally. For example, if you’re claiming you were injured in an accident, but you share photos of you out for a run, then it can cast suspicion on your claim.

4. Protect Your Credibility

The number one rule when working with insurance companies and opposing counsel is, to be honest, and protect your credibility. Exaggerating the extent of your injuries to bolster your case may come back to bite you and damage the entirety of your claim. If you’re not sure how to answer a question, always check in with your attorney rather than stretching the truth.

5. Don’t Take the First Offer

Insurance companies are there to protect you and others in the case of an accident, but that doesn’t mean they want to payout. Assume that their first offer is a lowball offer and, if your attorney advises it, hold out until you get a better offer. This might mean going to court, which is a longer process.

You’ve Learned How to Win Your Personal Injury Claim!

This information is applicable to all personal injury claims, whether it’s an auto accident or slip and fall case. Learning how to win your personal injury claim is an important step in recovering financially from any type of injury. Remember, the sooner you get legal representation, the better your chances of success!
